He failed to be a threat when he exited the vehicle and walked away, not pointing or shooting the weapon at anyone. Phil should have dialed 911 and possibly followed the kid.
Instead he chose to run him over and now he will be facing criminal and civil charges. Phil will never wear a pair of Nike's again. He will lose his freedom and his future. Everything he worked for will be stripped from him because, like the kid, he chose poorly.
