Law is a law.
If it was a medical emergency then he should have called the ambulance. I would say that he has no chance of defending this on the court.

Also I am little bit confused on this, so he has a medical condition(Emergency???) and he went to the airport to pick up a ticket? Then he thinks that he should drive on the HOV lane so that he can make it to the appointment?

If he goes to court, he definitely shouldn't mention stopping at the airport because it makes it seem as if his doctor appointment wasn't so urgent that he couldn't run an errand on the way. He should have stopped at the airport after the Doctor appointment then he would have more time to make the appointment.

I'd take it to court, but I think he's screwed.

If it were an emergent life or death situation requiring immediate medical attention your uncle's physician should of arranged for critical care transport. On going arrythmias is life threatening and your uncle is in no condition to drive. Imagine the disaster that could had happened if he had an acute M.I. behind the wheel. Anyhow, sorry for the unfortunate situation and best wishes to your uncle.

I can only assume his doctor told him it was okay to drive.

Also, sorry I messed up on the story a bit, he did not go to the airport before his appointment.
