80 in a 40mph zone
So i got pulled over the other day at about 3 o'clock in the morning doing 80 in a 40mph zone. Should i plead guilty, or should I try to fight it? The cop was extremely nice about it i was probably doing about 90mph with the streets completely cleared. Im not saying it wasn't stupid. Considering I'm 18, it was actually retarted and reckless. Obviously I've learned from this inncodent, I was just having a really bad day.

LOL at OP's name. I'm sure he was nice. But can you afford not to fight it? Your insurance might shock you next year. My thought is fight it anyway...what is the difference at that speed between 40 over or 50 over (if it goes up to actual). |

Fight it through writing and hope the officer doesn't turn his In. There's a Thread somewhere here on doing this and It will be your best bet.

Geez, that's jail time in IL. The meth freaks and thieves get community service. Speeders go to jail. Go figure.
I look back on the idiocy of my youth and wonder why I'm still alive. Speeding tickets suck, but at least you didn't have to learn a lesson by wrapping your car around a tree. Good luck with the fight if you choose to do so. You can always hope the cop doesn't show up in court. I've squeaked out of tickets that way.

Get an attorney. Cost you $300 + the ticket cost (if its not dismissed) and won't show up on your driving record.
you will have about 75% chance he messed up on the ticket and you will get off 100% considering it was 3am and if not it will be reduced. |

I'd definitely check local laws and possibly pursue legal council. X2 the posted speed can mean suspension of licence with possibility of more severe penalties in my state (MN). It is in your best interest to at least plead that down, I certainly wouldn't want it on my record...

If i do get an attorney and we proceed to court. Would the officer have to testify? Because I dont know how its possible for me to get off of this one. He purposely didnt give me a ticket for reckless driving, which is a criminal offense. But is emotionally disturbed while driving an ability to get off? Because earlier that night my good friend committed suicide, and i found out about an hour before I was heading home.

I had lunch the other day with a local traffic cop. He just LOVES when people challenge with trial by letter and eventually court appearances. He will never miss one. If he's not on duty, he gets 4 hours OT to show up. The courts will NOT schedule a trial if the officer has leave/training already scheduled. The only way he won't be there is if a major event occurs on the street while he's on duty just before the court appearance.
