I could be wrong, but I beleive the law is to the effect the pedestrian ALWAYS has the RoW. The issue at hand would be whether she demonstrated her intention to cross the street and you failed to yield. Your indication that she was pressing the crosswalk button repeatedly would go a long way in support of your claim that she had every intention of crossing WHEN THE HAND TURNED GREEN and not at the very moment.
It's something, if you can be respectful, to discuss with a traffic judge. Do yourself a faver, take the ticket out and look up the vehicle code you supposedly violated, and read the details, as MA rules may be different than CA rules. |
