BMW Warranty Problem!

I just bought my 2007 BMW m6 from BMW Financial Directly. The car has 28000 miles and is under factory warranty. I drove the car for two days and it seems like my tranny went bad. The car was Green light ready to go vehicle with nothing disclosed about the transmission. I toweed the car to my local BMW whom i dealt with for years. They're saying the history box(Black box?) of the vehicle shows a overrev of the car and thats why theres problems, he's saying this is not covered under warranty because it is abuse. He estimated 8500 in repairs.

The next day he told me he'll see what he can do if its a clutch he will replace it, if something BLEW UP because of the overrev in the transmission i will pay for it and it will be now 3900.

It is now day two and i guess I will see whats gonna happen by Monday.

I am wondering what to do and how I can fix this problem, Should I contact BMW NA? Should I tell them to do a one time customer courtesy?

Please anyone with knowledge and information please help me out! Thanks

I didn't even know that there was a black box? I thought there was just a DME which you can clear with BT tool. I am interested in learning about the black box too. Free Bump

what you should do is find out more info about the overrev. the ECU should document the mileage, rpm, and maybe even date. if it was before you bought it and through a BMW dealer (CPO?) they should be more willing to help you out.

Check on the time line. Maybe the previous owner did it and you shouldn't be responsible for it.
