Is 101mph the actual speed he was going or is that the "discounted" rate which the officer wrote on the ticket? It makes a huge difference. I think he has more of a chance if it was the actual speed. But if that's already a discounted rate... he fucked.

Absolutely get a lawyer who deals specifically with traffic citations and try to get it reduced - Try to find someone who can talk with the cop to get him not to show for court. Maybe another cop/agent. Doesn't have to be from the same department or agency.

I got out of a speeding ticket with a lawyer 20+years ago. Had to get my speedometer recalibrated - well at least show the reciept that I had it done. I wasn't going that fast though.

As others have stated, a lawyer is a great idea. You are potentially looking at a Reckless Driving charge (VTL 1212), which is a misdemeanor, just due to the excessive speed. This can actually also lead to an automatic suspension of your driver's license. The lawyer will be wrth the money spent.

I hit 120+ on west side highway, its pretty much dead late at night just swarming with cops. Its not so much hitting 100+ its staying there that's a problem, west side is full of traffic lights and curvy roads so he was just really unlucky and got caught on his acceleration because there is no way he was just crusin at 100.

I don't know if the cop discounted it or not but I know he's a dick since he wrote 101, if he just discount it 2 mph to 99, it would be so much less severe.

seriously though, over 100 in the city... where?!

thats true however you can work something out with the judge which in case will speak to the cop if he has an objection if he/she doesnt than it could happen.... probably west side highway

Yes a matter of fact it is magic. The magic of $.

Having a Lawyer (private) means that you have the ability and capability to go to trial. Its not about winning or losing the trial because chances are you are probably going to lose. However it is about time. A good lawyer would have a reputation in the local courts as some1 thats not afraid to go to trial if no reduced plea deals are given. They do this not because they think they can win but to waste the courts time and resources. A court have only so many court rooms, judges, commissioners, DAs, transcripters, funding etc. If no reduced plea deals are ever given to any traffic lawyers and only 1/3 of those lawyers decides to go to trial, the court calender will be so jam packed, a case would not be heard for more than a year and the courts will risk having to release some violent offenders due to the right to a speedy trial. So in order to avoid this, the courts will give reduced charge, fine plea deals to traffic lawyers just to get them off their backs so they could save the resources to try all the violent felony cases.

So in simple mathmatical formulas...
you are paying the lawyer $$$ to waste the courts $$$ if the court won't reduce your ticket $$$.
This is also why the DMV is the muther fucking grand daddy bully because driving is a privilege, not a right, they don't have the time constraint issue as the courts so they can just do whatever the fuck they want. A lot of times the DMV will suspend your license even if you plea it down in the courts to no court suspension.

This is all even without mentioning that lawyers can spot weak points in police reports that we can't see, and thus using it as a "threat" to go to trial and maybe win if the DA don't hook it up with a sweet deal to not waste everyones time.

If you have a public defender, then none of the above applies and you are guna be lubed up for some prime time double penetration of getting fucked both ways. No offense to any PDs out there but admit it, you are ALL in bed with the DAs

as someone already posted in nyc you cant negotiate the speed down but dunno if a lawyer could or if they would have to take it to trial. You could also find out who could possibly be a traffic judge and hire them to do bs work and then they cannot be your judge so if you did that with every traffic judge then they cannot prosocute afaik... and there are so many lawyers that will say that they can help and will do nothing and charge you thousands of dollars so be careful before you retain one. if they say they will get it dropped that is illegal in itself...

Has anyone been in this situation in NYC before?

Other stories or valid advice would be helpful! I'm just trying to see what a likely outcome would be.
Tell your "friend"...he's an irresponsible asshole!!! Not only do I hope the ticket sticks, but I hope at some point "your friend" loses his license. There is not one place in NYC where it is safe to do 80...let alone 101!!!

You miserable cocksucker...I have an 11 day old son...who I am comfortable to say is "now the center of my life". You (sorry "your friend")...being as irresponsible and thoughtless as he is...put HIM in danger.

In NYC...there is nowhere to go...nowhere to get out of the way...you create an unsafe scenario for the millions of pedestrians in this city...at ANY time of day...in ANY part of NYC. Day to day...you assholes never stop amazing me in the streets.

There are PLENTY of places outside the city to USE your car. PLENTY...why do it here and put all of US in danger?

Tell him to do me a favor and either stay home, drop dead or GROW THE FUCK UP...damn...if I had the chance the right now I'd ring your fucking neck.

"Your friend" is a MORON!!! You don't need "friends" like that...

That is a bit harsh, don't you think?
The segment of BQE between Prospect Expressway and 65th St exits is perfectly straight and can be quite deserted at night... kind of like the Mulsanne Straight in Le Mans 24.
Weaving in and out of traffic is reckless driving. Letting the engine sing in the dead of night is not.
