This dude probably thought the same thing... oh wait no he was "distracted by his homework". Chewing gum hardly compares to texting. I can breath and walk... so therefore I can multi-task.

If I see someone texting and I'm on the motorcycle I get as far away as possible. If it's in traffic I either get behind them or change lanes. I don't want a Chevy up my ass because they didn't see I stopped. On the bike I'll sometimes stare at them and try to get their attention once I'm out of the way. That probably does nothing.

When I'm in my car I normally do the same thing (minus the starring) but am less aggressive / concerned with getting out of their path. Motorcycle I'm out of there once I see they are consistently looking down.


EDIT: Agree...not sure how I feel with laws about it. But I also don't see how else to punish reckless drivers. I live in VA where we can't legally have radar detectors... banning texting while driving is something that at least makes sense!

Having a drivers license is a privilege, not a constitutional right. If you are unfit to operate a motor vehicle, then you should not have the privilege to drive. I don't want to get killed on a motorcycle (or car) because a driver is busy texting his/her buddies about misc bullshit.

If I see someone texting at a red light, I'll honk. Sometimes they know they weren't paying attention, think they missed the green light change and floor it through a red light even though it's still red. As they're t-boned by a bus I chuckle and say to myself "that'll teach 'em"

Heh that works best if you time it so that the guys in the left turn lane get the arrow, but the texter is still in the through lane and is first in line. They get startled and see that the lane of traffic next to them is going so they instinctively go. The horn helps push the agenda.

The constitutional right to travel freely came about before the automobile. But I do see having to regulate things since they're are so many more people now coupled with the fact that they are 'travelling' in something much faster than a horse and wagon. The wee little problem comes two fold though in terms of punishment. One, for a crime to have been committed there has to be a damaged party. Unless you run someone over while texting there is no damaged party lol. And the much larger issue is the fact that once we go get a license, we technically enter into a contract with the issuing agency (DMV) however there is two things wrong there. First, the contract is not disclosed to you and second, both parties haven't signed it. Under contract law this makes it null and void. Unfortunately we can't use that as a defense to a moving violation because traffic court isn't concerned with 'law', only collecting your money aka revenue.

But that's a whole other discussion

What? Since when? Click it or ticket has been implemented in many states for a long time. A lot of people aren't injured from not wearing a seatbelt, but you can get a ticket for it in a lot of states.

You could apply your same logic to DUI's... How many people drive drunk and are fortunate enough not to injure themselves or others? Does that make it OK for people to drive drunk? Absolutely not...

Didn't even hit the brakes. Hit the guy full on.

The same logic does apply. I'm not saying that you won't get a ticket/arrested for any of the above. I'm simply stating that the law states that there must be a damaged party in order to bring forth action against you.

That's almost never the case. Due process has somehow disappeared from the whole thing.

So by sitting at a red light stopped and not hurting anyone, you want them to all of the sudden create an accident? That makes perfect sense!

Two of my friends had their cars totalled by a girl who was texting and driving at 4 AM in the morning (shockingly she wasn't drunk). She hit the one car first, backed up and went forward into the other. Cop stopped her a town over because her front bumper was literally scrapping the ground. She ended up crying and telling the cop what she did.

Where does the law (whatever law you're supposedly referring to) say that?

If you're caught on the road driving while intoxicated, you're put behind bars or you lose your license and you're fined. It's illegal, whether you injure someone/cause damage or not. It has nothing to do with due process...

Are you really trying to justify that texting while driving is perfectly fine? Because it's not. Hopefully they start fining and taking away licenses for people who are caught doing it. I'd be satisfied knowing dangerous people who can't keep their eyes on the road are out of my way, making it safer for me and my family.

So you're saying that - because nothing's happened YET - that it's ok? Just because nothing drastic has happened does not meant that you're not creating an unsafe environment for others. It's a red light, sure, but you are in the middle of a most likely busy intersection with your vehicle in first or 'D' with cars zooming by perpendicular to you and pedestrians passing mere feet from your bumper.
