Funny how the OP has not chimed in at all with a further reply or explanation.

As was said above.....the whole 'animal in the road' story is just that. It is his story so that he can collect from the insurance company. Reality is likely what was said above....inexperience, trying to impress a girl, night time, overpowered car for his talent level...etc.

How did you get help?
Was your cell phone right where it was before the wreck?
You both went down the side in violent fashion and then climbed right back up?
Did you carry her up?
Walked for help?
An ambulance took you both?
All that broken glass and nothing more than a few minor cuts?


The sheer pressure on the body while tumbling with glass fragments in the cabin would seem to have done some serious damage. Let alone no evidence of head injury. Not even a concussion or headache.
Hmmm. Nothing but a few minor cuts. Hmmmm.




I could be wrong but I think that car did a Peter Pan with no Peter in it.

Eh I think I believe the accident itself was real...not sure I believe the circumstances surrounding it though.

I am not trying to be a doubting Thomas but something is not right.

Look at that car and to just walk back up and hitch a ride home?

The OP's vanishing act is puzzling too.

Can airbags deploy with no occupants? If not then I retract my statement.

How did you get help? called 911, they didnt help much, bmw assist called my cell phone once i got up the mountain and they sent a CHP car up.
Was your cell phone right where it was before the wreck? my cell was in my pocket, the girls cell flew outa the car and still lost somewhere there.
You both went down the side in violent fashion and then climbed right back up? yes we climbed back up, i was dying in pain, she was bleeding on her left arm from the cuts.
Did you carry her up? no
Walked for help?no, bmw assist sent chp car up.
An ambulance took you both? no, chp took us to La crasenta sherrif department, and paramedics n fire truck came there. examined us both and left.

look guys.
whether you believe me or not. this is exactly what had happnd. I was in the car, She was in the car. if no one was in the car, the airbags wouldnt deploy. when BMW assist called me, the person over the phone asked me if i was ok then asked if the passenger was ok, without me telling them i had a passenger.

and no, i was no trying to impress a girl, and my car isnt overpowered. it was fully stock, i sold all my parts bout a year ago almost. just some show stuff left on car.

and i rarely come on this forum to even post or do nething.

message me, and i can get you a nice deal if ur around the area. the pics at the bottom of the page of the E92 335 is/was my car. so let me know.

Glad to know you and your passenger made it out okay with minimal injuries. It sucks that you broke your collar bone but I hope you make a speedy recovery.

Also, about the lawsuit against BMW for the airbags, that's a dumb idea. Be thankful their advanced engineering and designs saved you and your passenger.

i know, no lawsuit is taking place. it was just a thought, but after another look at the pictures, i went and wrote bmw a letter thanking them for their safety

im glad you decided to drop te lawsuit that would have been silly. and you are definitely right about about if people beleivin you ro not. i definitely wouldnt care if they did or didnt. whats important is thayt you lived to tell about it. asnd of course your insurance company believes your story

panicked at 35mph because of animals on the road? the 'official' story doesn't add up. that's 56km/h. school zones here are 40km/h and people do 50km/h through them. that's not much slower than what this guy said he was doing. either alcohol was a factor, he was doing a LOT more than that or he was getting a bj while driving and wasn't paying attention. or he's just an idiot... a very lucky one.

But seriously I doubt I believe that OP was doing 35 mph. 35 is a speed that you can easily maneuver. But for that to happen, it seems that it was a twisty road and just letting it go. OP the car is not overpowered as you say but it has power, even its stock!

The OP is very lucky - after that the story just doesn't make a lot of sense.

But it seems to be ending well, the stupid lawsuit idea is dropped, he's thanking BMW for building a strong and safe car and the gf hasn't sued him (yet).

The beat goes on.
