A man is walking along a sidewalk, comes to a T intersection. As he starts across, a vehicle approaches. He slows, but the car simply pulls a rolling Cali right in front of him.

IF he throws a rock, is it self defense?

Probably be best not to have authority figures have to make that determination...my suggestion is that after throwing said rock, the man, having slowed down, immediately switches to high gear and books it off the scene.

I've always found that when doing something questionable, it is even better if persons of authority aren't aware of it in order to make a determination.

Nope. It's a 23110 CVC violation.


...but the driver is also guilty of either running a stop sign, a violation of 22450(a) CVC or failing to stop for a red light, a violation of 21453(insert subsection) CVC......whichever is applicable.

I don't know what that is, I'm not going to look it up either, I'm just going to go with my gut here and say that I think you are being a party pooper.

And also mention that you are probably proving my point about it being better that authority figures are not present (along with you - you can have one or the other, but detrimental to have both parties there) to make a determination on questionable actions you undertake.

Assuming there's a crosswalk, there's the possibility of failing to yield to a pedestrian in a crosswalk, a violation of 21950(a) CVC, but pedestrians don't always have the right of way, hence the jaywalking citations (...21955 CVC). Pedestrians are subject to CVC laws just the same as vehicles.

Ehhhhh! These gangsters that flee on foot aren't the easiest to catch, especially with "friendlies" in the area. They can cover blocks very quickly.

I try my best to avoid foot pursuits and if a vehicle pursuit starts to get out of hand I will back off (...entirely dependent on what I'm chasing).

Last night I was just walking da hood. Residential street T-intersection, no jaywalking involved.

Oh, sure. If I happen to drive towards an officer randomly jaywalking, I get charged with ADW. But some ped, just minding his own business, taking a nice little stroll after dinner gets clipped, and in self defense tries to get a rampaging driver's attention, and you throw 23110 at him

Most of the precincts here are in very congested areas. Parking is designated for police vehicles only, which includes their personal vehicles which are identified by a placard.
