If I (as a normal civilian, not a celebrity) were exceeding the speed limit on a public road by more than 45mph, would the police still call it "an unsafe manner for road conditions" and not bother with giving me a citation?

Just curious here. I'm betting I know the answer. And I'm betting someone tied up the hands of the police here too.

With no independent witness(es) it cannot be proven even though the suspicion is there. There are many considerations, but excessive speed is a factor. In order to prove reckless, an officer/deputy needs to observe the driving behavior OR have independent witnesses.

Yes! It happens all of the time. I've chosen not to write citations for it myself. I could upload photos of traffic collisions I've written where people were injured and I still didn't cite party #1.

They estimated 75mph, but as fast as 87mph. I always think those numbers are suspect though, unless you were there, or could get the data from the black box (which it might have?), it's all speculation. You'd have to test over and over under the same conditions, same vehicle, same temp, same wear on the tires, same reaction, same skid-mark distance, I mean, it's literally impossible.

On a side note, my little boy loves to watch Heavy Rescue 401 before he goes to bed, and just last night they showed what I thought was just off the charts weird. It was an 18-wheeler with a full load that reacted late, slammed on the brakes, totaled the stopped car in front of it, and went on to rip it's own driver door off when colliding with another 18-wheeler.

The thing that was weird was that the HP needed to get an idea of the speed the truck was going, so he, in his completely different large SUV, did a speed test and slammed on the brakes to test the surface of the road for slickness.

Among the things that made this weird were...

1. Completely different vehicle/tires/load/reaction/etc.
2. Different time/climate/temp/pressure/etc
3. The cop's SUV actually locked up the brakes! ABS??
4. They thought they might glean ANY pertinent information from it.

Things that make you go hmmm...

Really? I'm surprised to be honest. I can't imagine I'd get away with it up here if I caused an accident. Even if no one was hurt.

Yes it's common. Not everybody is cited following a collision, especially a solo car traffic collision with no serious property damage.

It's all on the officer(s) at the scene and their judgement. I know of someone who was once stopped for 115 mph in a 50 mph zone AND construction zone. No ticket and a verbal warning. No traffic and my friend was very apologetic and remorseful with a logical reason for the speed.

I also know of people who have gotten ticketed for 65 in a 60 with improper lane use and a few other factors because they were driving dangerously.

Speed doesn't equal danger at all times. All speed does is exacerbate problems if they occur and the driver is unskilled at car control (Which, unfortunately, most are).

True. Plus there is a ton of hit and miss. I’ve gotten away with more than doubling the posted speed limit before, but I’ve also been cited for 74 in a 70. It was 6am on a Saturday and there wasn’t any cars on the road to go after I guess.

I will miss Europe. No cops chasing you here. Just speed cameras everywhere. Sometimes you get the high score and have to give up your license for a month. Most times it’s $20 fine in the mail. And unlimited autobahn. Love it.

I do get the difference, but honestly I don't think I'd manage to get away with a warning up here for doing 72 km/h over...just can't visualize it. I think it is just my mindset, different country type thing. Personally, I'd like more discretion to be used, so I think that's a good thing if that is what happens down there.

That, plus skid marks will tell you everything you need to know about the speed and about factors such as ABS activation (...which results in skip skids), yaw, etc. You don't need a black box to calculate how fast someone was going. Vehicle debris is another indicator.
