I'm not familiar with the laws of Maryland, but as a Juris, I would disagree with you. Many states have laws favoring retreat if possible. Notice that the garage to the home was detached. The student had already called police before walking over to his garage. He could have easily stayed in his home and neither his own life nor the intruder's life would have been harmed. Many B & E's are perpetrated by the homeless in an effort to find property to sell to obtain money for food (or habits). These people do not care if they are caught and arrested, because jail means free food and shelter.

I don't see why they would even hold him in custody. The felon is known. The guy did the cops a favor when he totally ganked him.
Felon has been in jail a few times, he won't change... no one knows when the cops were first dispatched maybe samurai jack ran down while the other roomies called the cops. would you let some guy who robbed you get away and say "well, I'll wait till the cops get here and then they will tell me they cant find him, and he'll come back again tomorrow." screw it, I'd grab my sword and dismember him slowly and shove his own leg in his mouth.. the make him bleed to death.. if the paramedics get there in time good.. if not, tough luck.. that'll teach you to B&E

Had it been a 9mm or .40 semi auto, no one would give this story a second thought. Now, if an AK47 was used and the burglar was riddled to shreds, that might be deemed excessive use of force. |

This story has more to it than was reported in the link. On the news, there were multiple break-ins previously at the residence. The burglar also was a career criminal that was recently released from jail for B&E. He got what he deserved. He didn't learn his lesson before and got the short end of the sword.

I'm extremlely fearful in touching any major weapon........But if I had no choice, I don't know what I would've done in that moment.
I would've defended myself for sure, but I'd really hate to kill someone. It would be a painful moment, but there would be no time to waste. |
