haha thats why dodge is almost bankrupt

cliff notes-guy bids 29.1k on 09 srt8 challenger and wins the bid bc they forgot reserve, now he is fighting it

what does this have to do with Dodge? This is a dealers' mistake not the manufacturers.

well if that dealers sells FOR dodge rather than buy them then sale, then dodge will lose money too, im just saying they tend to make a lot of dumb mistakes

for instance the pt bruiser

I bought a 2008 Ford Escape XLT for $14k because the dealer/seller forgot to put a reserve on. Going price at the dealer for this truck was $21k at the time. They left me a nice little "damn you for winning" email but I still got the car. thank you ebay!

there's not much the dealership can do. they can fight all they want, but they won't win in any court in the land. there are too many other "case laws", if you might say, of similar situations. lawyers will argue that and win every time. dealer entered into a legally binding contract, they snoozed, now they lose. i love it when stealerships lose

There was a dude on here that won a Lambo in the same fashion IIRC. Seems to be quite common.

Don't use ebay to sell valuable items if you don't know how to use it correctly or are too careless to make sure you haven't made any mistakes IMO.

Yep, thought of that msyelf. I think if the guy presses hard enough there are plenty of other cases having this exact same experience, the dealership will be forced to honor their end of the contract.

Assuming the guy gets the car, I hope he's at least smart enough to sell it and make a profit.

That's roughly a $15k price difference right there vs. what it should have cost.

It all depends. Maybe he really wanted the car. If I found a 335 for $15k cheaper, I would drive it and not sell it. This car, I would sell.

Well it's an '09 with a previous owner now, correct? I'd imagine that would hit it pretty hard. Still, he'd make out with a profit, or a helluva car for what he paid.

They will refuse to accept it. The guy lives very close to the dealership. They did just that when he walked in with the deposit. He even walked in with the full amount within the 5 day period mandated by the Ebay contract. He hired a lawyer if I am not mistaken. This story is going to be bigger than the M3 one. It is on jalopnik and on over 100 forums already. This dealer is getting some really bad publicity.

Online auction it's a legally binding contract, but there is a way around it for the dealer. Like if the car is no longer available for reasons beyond their control - i.e., car "stolen". If you know what I mean.
