PayPal disputes.

So I bought a "Lego Set" for my kid from www.bricktrainshop.com.

It seemed pretty fishy from the beginning, because the set was $90 everywhere else, but that place sold it for $14. The product name, demo video and product images all look legit. Read some good reviews about the site also, so i decided to buy it. So $14 + $6 shipping seemed pretty good... or so i thought.

3 days later I open my mailbox and there it was... a yellow envelope with nothing but an instruction manual in it and a crumbled up piece of paper saying "Thank you for choosing Brick Train Shop for all your INSTRUCTION MANUALS"

Stupid motherfuckers. $20 is not that much but damn, my kid was super bummed when he saw it. So i file a paypal dispute and these bastards deny it, saying that i will have to send it back first, paying out of my pocket for shipping and then they will charge me 10% restocking fee!

Quote:
All returns are subject to a 10% restocking fee, this policy was instated due to a high number of persons ordering manuals and then copying them and returning them. It is unfortunate that we have to operate this way but it discourages dishonest people from buying from us.
They sell manuals to people thinking they are buying actual Lego sets and then they have balls to charge restocking fee.

Again, $20 is nothing, but it is a matter of principle and a very bummed out kid. They are going to take $1.40 restocking fee, plus i have to pay $5 to send it back, but I do not think i should be paying either one of these.

Can i just have PayPal reverse the transaction? I could not care less about these fucking manuals, and I am willing to send them back to these assholes, but I do not think I have to pay shipping/restocking.

don't see anything on their website that says instruction manual or anything. No listing on ripoffreport either. No negative publicity on google either.

If you paid with credit card you should call them. You could file a dispute if you like but it might take a while.

That is BS - got a link to the item?

I bought a book on Amazon a long time ago, and it never came (paid with paypal) so I said the product never arrived and I got my money back. Then it came like 2 MONTHS later, weird.

Can you say it never arrived, because technically it didn't - only the booklet did.

And yes, Paypal will probably reverse the transaction. I hate Paypal, but we sell a lot on ebay (and basically have to have it), and Paypal is DEFINITELY on the buyer's side. If you use your account a lot, know that it might get "frozen" for a while.

http://www.bricktrainshop.com/Lego_B...42_396227.aspx

here is the link to the item.

I guess the category says "lego instructions", which i *just* noticed, because of the excellent colors they chose and somewhere in the description is mentions something about manuals, but not really all that clear. Also, when you search for "8943 "Axalara T9"" it does not
show the category.

but pretty much everything else in the description points to the fact that is a real lego set

title: Lego Bionicle Set 8943 "Axalara T9" (does not say its a manual)
summary:

Quote:
The ultimate fighter!

Lewa Nuva is ready for battle in this massively powerful battlecruiser! With dual Midak Skyblasters and tri-arms featuring lasers and force field generators, its mission is to smash the Brotherhood of Makuta while there's still time to save the universe! Includes special-edition Lewa Nuva figure! Raise and lower the landing gear! Sides open to reveal the dual Midak Skyblasters that really fire! Turn the gear on the side to open and close the tri-arms! Hold the handle underneath to fly the Axalara T9! Lewa Nuva stands 7½" (19cm) tall! Measures over 20" (50cm) long and 13" (33cm) high!
7 1/2" x 20" x 13" .... have you ever seen an instruction manual with these dimensions?

There are 2 videos that also show the actual lego set.
And out of 3 product images, 2 show the actual set.

I guess it's somewhat my fault for not scrutinizing every damn word on the page, but damn, how hard is it to make it clear, that this is a manual and not the actual set?

We're unable to decide this claim in your favor at this time. PayPal's Buyer Complaint Policy applies to the shipment of goods but not to disputes about merchandise quality.

We encourage you to work directly with your seller to resolve this matter.

You could file a dispute with paypal. The seller will either refund you everything or they will come back and said that the product was shipped and they have a tracking number for it. Then it becomes a he said, she said kind of thing. Best thing to do would be to just call your credit card through paypal you should give them a call. If not, just contact them and tell them that you will file a dispute (take screen shots too in case they edit things).

Tell Paypal that it didn't ship. They shipped the instruction book but not the item?

That is very misleading on their page, also if you add the item to your cart, it doesn't say instruction book anywhere.

I'm sure you are not the only one, so they should really have something that says "THIS IS FOR THE INSTRUCTION BOOK ONLY."

If it's too good to be true.......

It's a matter of principle. Shit, i don't even want to waste my time going to the post office to send it back. Total transaction was only $20.16, but now i have to pay $6.40 to get $18 back, for the item that was clearly NOT as described, so even though they pretty much scammed me, they still get to keep some of my money. Fuck That.

I did order him a new set already btw.

This reminds me (unfortunately) of the Judge Judy episode where the fat chick sent a picture of the cell phone and not the phone.

Is your PP account tied to your CC? *(I hope so, and not your bank checking account). If it is, you can file a dispute with your CC since PP told you to fuck off.

if its too good to be true, then it probably is, lesson learned. send it back move on.ive done this myself a few times on ebay, hastily buying something to save a few bucks with out thoroughly reading the description.

I don't know if you guys realize this, but the item he bought is listed under the "Instruction" section. I do agree that the main title is misleading and should be more detailed, but I don't think they are there to scam.

I think the way to go in this case is to eat the $20 yourself, but demand that the company update their pages to say "Instructions ONLY" in the title.
