My spoiler came damaged!!!
Hello,
I'm not sure if this topic fits on this category or not.. but I'm posting anyways. So I ordered E90 OEM style AW painted spoiler from Ebay, and I got the spoiler yesterday night. The problem is that, it came with damaged ends! I think I might have paid for the shipping insurance..but I'm not sure. Would shipping insurance cover the return shipping as well? Seller says return shipping is my responsibility... I'm really :mad: and lost... Anyone experienced this? How did you solve the problem? Thanks! |

Check with the shipper. If you have insurance they should cover the cost to replace it.

What shipping carrier did you use?
Where did it come from? You need to contact the seller, then find out what kind of claim is available based on the shipping method used. If you did not get insurance, then you are pretty much stuck with a broken spoiler. Some shipping method has a coverage to a certain amount, so you really need to find out what method was used and what kind of coverage it has. Just make sure you don't throw away your packaging, because they would want the original packaging shipped back to file for claim.

Is it still possible to claim on shipping insurance after signing for a package? I remember reading from many different companies that the recipient should always check for damage to the box on the spot before accepting delivery. Just thought I'd mention this.

I think you're allowed a period of 24 or 48hr to inspect the goods, not sure though, definitely look into it

The seller is "delsa-motorsports" from Ebay.
They reply fast usually, but I haven't heard from them for almost 3 days. Now I'm really getting worried with all these 48 hrs to report to the shipper (which is Canada Post) that some of you talked about. |

Before I bought the spoiler, they replied within 6 hrs!!! But now, I've sent three e-mails, and no responses for last three days! How do I make claim on paypal? The problem is, I didn't order through Ebay. I contacted Alex directly, and he sent me the paypal invoice. Am I still eligible for the paypal claim? What other ways would there be in case he doesn't contact me? (Should I just take the damaged spoiler to local bodyshop and see if they can repair it??) |

So I finally got in touch with the seller, and he says I should return the spoiler at my expense. The insurance wouldn't cover it as the box itself is not damaged.
UPS asks for CDN $216 and Canada Post asks for CDN $146 to ship the spoiler to Taiwan. It's almost the price of new spoiler!! Now I'm really out of the choice... The seller wouldn't pay for the return shipping, and the shipping cost is ridiculously expensive.. Do you think it can be repaired at the bodyshop?? ........ can't think of anything else..... if the box wasnt damaged it seems to me like the spoiler was sent damaged. i would demand the seller to pay cost of shipping back, but if its taiwanese, i dont know if there is any way to enforce that. if they did in fact send out a broken spoiler, i wouldnt advise messing around with them for a replacement either, probably just run into more headaches. i would try to get a full refund and cut your losses.

yea, from the other threads, delsa seems to reply quick when they're trying to make a sale. if you're inquiring about other things, such as where your order is or your order is damaged, they're no where to be found.
i agree with long, you might just want to go through paypal.

Yup.
Now I'm trying to figure out if I could return the spoiler to their BC office which is like 1 hr drive from my house. I remember seeing some of members trying to contact their Canada office directly. Any luck on that? And once again, no response yet. I'll wait for their response until next Tuesday. If they don't respond by then... hmm.. |

Demand that they take care of it being as the spoiler was proabably shipped broken. Tell them that you will leave negative feedback on ebay if they dont become reasonable with their offers to recitfy the situation.
I had a similar situation when I ordered my OEM spoiler through Pacific BMW. The spoiler was broken fromt he beginning. They would not even return my phone calls until I called BMW NA and filed a complaint with their online parts department. Go figure, I got a call back within the hour... Everything was takend care of through the threats of BMW NA (I guess) File a claim through paypal. Tell them exactly what you have told us. No damage to the box, and the item is damaged. The seller is refusing to accept responsibility for the damaged product that was shipped, and you should not have to eat the cost to ship it back to its origin. Paypal was great in dealing with a claim of mine a while back... |

i dont think you will have any luck with the canadian office...notice that when you buy from them, they say that they will ship it from the canadian or american warehouse to save you duty...then something goes wrong and you gotta send it to taiwan..what a bunch of bull...i would not recommend anyone else on this board ever buying anything from DELSA. i'd cut your losses now and just try to see if the body shop can fix it...in my case, it was just cheaper to buy a new spoiler than to have them sand it down, prime it and repaint...GL
