Should there be a disclosure for trade-assist buy?

Since there's a number of 335's on the market that BMW did trade-assists on, is there a legal obligation by the dealer to disclose the fact that the car was traded in thru' the TA program? I know all states have some stringent lemon laws, but these cars are not lemons per se, so it will not show up on a Carfax. The details of the problems with the vehicle would be on BMWNA's records, so should there be a process to check with them first? Also, if the 'problem' car is traded in at a MB dealer as an example, there's no way they would know the history of the vehicle, since the title and Carfax would come back clean.
I searched and it seems these cars do come at a discount, also, is there an opportunity for the same car to be a candidate for TA again?
Reason I'm doing all this research is I dodged a bullet by calling an SA to do a quick check on the VIN and it came up as a TA. The non BMW dealer denied knowing anything about this issue - and they just fell back on the clean title ; clean Carfax and remaining full maintenance/warranty.
I think there should be a legal obligation of disclosure; an update to Carfax, but the title can remain clean.
What would you do if you found out that the car you purchased was part of the TA program, but it was not disclosed to you?

If I remember right, a BMW Center would have to disclose it, a non-BMW franchise doesn't. That's why many people should be leary of 'deals' at other places, especially like CarMax
