How to deport someone?

I have someone who's Visa has been revoked... I would like to have them out of this country... What can I do? There is a story behind this and I promsie Ill post it but for now I'd liek to get some more info. Thanks.

Contact the INS (Immigration and Naturalization Service), that's the department responsible for enfocing immigration "issues".

One of my employees in my restaurant keeps making mistakes. Should I deport him....hmmmm.

You can't just have someone deported because their visa was revoked, they have a time period to find another visa provider (I'm guessing this guy had a H-1 type visa and you revoked it) and even after that he still isn't set for an order of deportation.


Get him out of your life and move on, having someone deported is a very sick thing to do. They lose everything without having any chance to object. (properties, etc..)

Plus, in this case it's not that easy, he entered legally, and has maintained legal status, so they are going to allow that time to find another visa provider.

I manage a side business. I employed him with an H1B Visa. It has been two months since I revoked it, yet he still tells people he works for me... Recently I got a call from some employer asking if he still works for me, since his visa says my company name. He is obviously looking for work and using the Visa I sponsered. Theres a reason why he was fired and the quicker I can get him out of this country the better. I promise I'd give a story behind it. Im not a dick, there's a reason.

then definitely call immigration and tell them your story. they will take your details but make SURE your facts are the ones you stated above. at no time mention anything about him being foreign or anything like that - else they might put down something that he can turn around and say you're discriminating against him with . good luck!

Because you sponsored his visa initially your company is what makes him legal. Since you fired him he is now in a "change of status" type position, as long as you fired him and notify immigration that he doesn't work for you, there should be no problem if he goes around saying he does. Immigration will contact him and ask him what he plans to do to see what steps to take.

Like I said, do what you must and move on, who cares where he lives

what nationality is he?
i think with the h1b visas he has a trial period within that time he can get it transferred. i wonder what he did that you want him out of the country so bad. since we don't know the whole story i would not pass judgement. i know a while back, i wanted someone out of the country, but i felt pity for them and just left it at that instead of going and getting them deported. they were pathetic to begin with why associate myself and make me pathetic as well.
was not worth my time or effort.
but if u think you have valid reason, you can call INS.

the expiration of someone's status only means (in practical terms) that they can't re-enter the states.
this country is full of folks who've overstayed their visa. the only factor to make them a priority for deportation over others is if they've committed a serious crime, and last time i checked, lying on your resume doesn't qualify.

seriously, if the ins existed purely to rid the country of illegal aliens, they'd start at your local home depot.

People that get deported can figure out ways to get back. And he knows how to find you.

You have to contact the INS to effectively revoke his H1B. The new company will require to do a H1B transfer. If his visa is revoked, the company will not be able to transfer his Visa and will push him into the quota system. Since the quota for the yr is filled, there will be no room to give him one. He will have 30days to get another employer to transfer his Visa if you did not revoke it effectively. So after 30days, his H1B will be automatically expired (if you have notify the DOL that he is no longer employed i think?). I hope you won't screw up someone else over personal problems....I don't think it would be fair to him and you might someday look back and regret you ever do that. Getting into this country and a legal job is not as easy.

I've had a couple of employees that went thru this and here is how it works. Once you fire them, if i remember correctly, they have 45 days to get another job that is willing to pick up their visa otherwise they must return to their country. That is why he is looking for another job with your visa because unless he finds another job he will be deported.
