Disappointing .. We signed some papers & $1k.Now dealer says the car is not available

We negotiated a deal (1k plus invoice and 0.00160 MF).. he said there is a car available at another dealership and he will get the car down here in 2 weeks. He made us sign some papers .. and took 1K deposit. He didn't deduct the money though. Credit was not run either..

We went in to get some details from the dealer and he tried to avoid us, and then says they cannot get the car for us.. He didn't have the courtesy to at least call and let us know .. we asked for the documentation we did, and he wouldn't give us those either.

Can we complain to BMW USA about what happened and would it matter ?

What are our options ?

What exactly was signed?

Sorry to hear, but best bet is to move on to another dealer and keep searching. Do you know what dealer has the car they were going to trade for?

Just make sure they shred all the papers you signed if it has your info on it. Other than that I don't think you can do much except going to other dealership.

You can submit a complaint to BMWNA, but the best that will come of it is to share the details of the dealer here for other members to know. Otherwise it seems like you've lost the time you invested into it so far and nothing more. Go to another dealership who is willing to work with the numbers you negotiated.

Send them an email stating that because they can't deliver on their promise you want everything cancelled and your money refunded immediately. If needed, go to the dealership and ask to speak with the sales manager.

Either way, this doesn't sound like the greatest deal and the dealership sounds horrible. Walk.

So you handed over $1,000 and never asked for any paperwork/documents in the beginning?

This is common. A deposit is "taken" usually via a credit card, but the charge is not run. So you haven't paid anything. Realistically, there is not much to do except decide if you want to still use this dealer. If not, convey this, rescind the right to run the card for the deposit and walk.
